Applying for asylum as an LGBTIQA+ person involves specific rights and considerations within the Dutch system. Stichting Love Planet is here to support you in navigating this process.
1. Right to Safety and Dignity
You have the right to be treated with respect and to be safe throughout your asylum procedure. This includes:
- Privacy during interviews regarding your sexual orientation or gender identity.
- Protection from harassment or violence in reception centers (COA).
- Access to medical care that respects your gender identity.
2. The IND Interview
During your interviews with the IND:
- You are NOT required to provide proof of your sexual orientation through explicit materials. This is strictly prohibited.
- You can request a specialized interviewer or interpreter if you feel more comfortable.
- You have the right to explain your personal journey and the risks you face in your home country.
3. Legal Assistance
You are entitled to free legal aid during the initial stages of your asylum procedure. Your lawyer should be familiar with LGBTIQA+ asylum claims. If you feel your lawyer is not supportive, you have the right to request a change.
4. Support from SLP
Stichting Love Planet provides community-led support, including:
- Safe spaces to meet other LGBTIQA+ individuals with a refugee background.
- Workshops on health, wellness, and navigating Dutch systems.
- Peer support and case guidance.
